GIRL HANDED OVER TO MOTHER BUT CUSTODY OF FATHER WAS NOT ILLEGAL.

Present:       Petitioner along with his learned counsel.

On behalf of respondent Sarwar Malik Advocate has submitted Power of Attorney.

                  Unfortunate alleged detinue girl has been produced by ASI,  of concerned Police Station. Instant petition has been filed under section 491 Cr.P.C. Alleged detinue girl appears to be of  age of 13-years. It means that she is having age of discretion. Keeping in view this fact, unfortunate alleged detinue girl was stated in the company of her Mother. Call was repeated. All the accompanying persons with the parties were directed to leave the court room. In presence of learned counsel for both the parties, alleged detinue girl was examined she promptly stated that she wants to accompany with her mother, she was not in illegal custody of her father. Under these circumstances, instant petition stands allowed. Alleged detinue girl is handed over to petitioner/mother. She is directed to take care of the alleged detinue girl sincerely. All concerned have  affixed their respective signatures and thumb impressions on the margin of the order sheet. File be consigned to the record room, after its due completion.
