Accused present before this court under custody, who has once again
requested to record his statement, which is
recorded as fallow:-
Formal charge was framed today on
14.05.2015 and I did not plead
guilty. Now my inner self is awakened and I intend to confessed my
guilt that on 08-03-2015, I was present
near Bagh Wali Pulli, under the territorial
limit of P.S. abc where my past
friend handed over to me a small packet,
meanwhile police arrested me and also
took into possession that packet. As per
police there was 190-grams Charas in
that packet. I, inadvertently received this packet. However, I confessed my guilt with my free consent without undue influence.
I, am poor person. I be forgiven this
time. I, was every care in future.

In view of confessional statement, since
accused is previously non convict, rather he is poor person, So, taking lenient
view, accused is convicted U/S.9-B of CNSA and he is sentenced for two months Rigorous Imprisonment and to pay
fine worth Rs.20,000/-, in case of non
payment of fine, he shall further undergo S.I for 10-days. He is given benefit
of Section 382-B of Cr.P.C. Case property be destroyed, after the expiry of
period of appeal or revision, if any. Accused be sent to Judicial custody to
serve out the sentence. File be consigned to the record room, after its due
completion.
