The petitioner Shakeel has
applied for 670 dated 00-08-2011 for offence u/s 25-D Telegraph Act registered
with PS ABC, Multan.
2. The learned counsel for the
petitioner contends that there is unexplained delay of 8 days in lodging of
FIR; that the accused/petitioner is innocent and has been falsely implicated in
this case; that the accused/petitioner is real nephew of the complainant; that
the accused/petitioner is respectable citizen; that the accused/petitioner is
previous non convict and non record holder hence the bail petition be accepted.
3. The learned DDPP/Public Prosecutor has
vehemently opposed this bail application by contending that the
accused/petitioner is specifically nominated in the FIR; that specific role has
been attributed to the accused/petitioner; that the case against the accused
has been registered on 24-8-2011 and accused/petitioner remained absconder for
more than 1½ years hence the accused/petitioner is not entitled for the
concession of bail.

5. Record reveals that
accused/petitioner is specifically nominated in the FIR. Specific role has been
attributed to the accused. The accused remained fugitive from law for more than
two and half years. No malafide or ulterior motive has been highlighted on the
part of complainant and police. For the foregoing reason, the
accused/petitioner is not entitled for the grant of bail hence the bail
application stands dismissed. File be consigned to record room.
