INTOXICATED DRIVER ACCIDENT

Intoxicated driver accident
PLD 1966 S.C. page 1003

IN THE COURT OF (NAME OF THE JUDGE),
ADDITIONAL DISTRICT AND SESSIONS, JUDGE, (CITY)

(Petitioner) ----- VS. -----  THE STATE

Present:   Petitioner along with learned Counsel.
                Learned DDPP for State.
                Arif with record.

ORDER

Through the present petition, the petitioner has sought Pre-arrest Bail in case
FIR No.00/08, dated 00.00.0000, u/s 279/427, PPC, P.S.                (NAME AND CITY)
According to the FIR, the allegation against the petitioner is that on the midnight of 00.06.0000, the petitioner having intoxicated struck his vehicle with the complainant’s vehicle and caused damage to the same, hence the said FIR.
At the outset of the arguments, learned Counsel for the petitioner has pointed out that both the alleged offences are bailable and the petitioner is entitled to the grant of concession of pre arrest bail on that score.
Nobody has turned up on behalf of the complainant, despite service of notice, to contest the present petition, whereas the same has been vehemently opposed by learned DDPP for the State.
Admittedly, the offences u/s 279 and 427 are bailable and petitioner as such is entitled to the grant of concession of bail as a matter of right.  So relying upon esteemed judgment cited as PLD 1966 S.C. page 1003, the present petition is accepted and interim pre arrest bail is confirmed subject to furnishing bail bonds of Rs.30,000/- with one surety in the like amount by the petitioner to the satisfaction of learned Magistrate concerned, within a week.  File be consigned.
