APPLICATION FOR PROCURING CERTIFICATE GUARDIAN
ORDER:-
(1) According to facts mentioned
in columns of application for procuring certificate guardian; petitioner (real mother
of minors) wants to be get appointed guardian of persons and property of minors
namely ___________, ______________, _____________ and _____________.
(2) Grounds for being appointed guardian of
persons and property of minors are, for goodness & welfare, education,
training of minors.
(3) For procuring attendance/appearance
of respondent public at large, all legal steps from notices to proclamation in
newspaper were adopted/observed. But in
spite of all that, no one appeared on behalf of Public at Large to contest, so public
at large were proceeded against ex-parte. However respondents No. 2, 3 and 4
attended the court proceedings, and consented on appointment of petitioner as
guardian of minors.
(4) In evidence of petitioner, petitioner appeared as Aw-1. In
documentary evidence advanced; Death Certificate of deceased husband as Mark-A,
Copy of (Bey) form as Mark-B.
(5) In evidence of respondents,
respondents No. 2, 3 and 4 appeared as Rw-2, Rw-3 and Rw-4 respectively.
(6) No evidence on rebuttal.
(7) Arguments heard, record
examined.
(8) Oral as well as documentary
evidence of petitioner has fully corroborated averments of petition, so
prima-facie petition deemed to be proved. Resulting present application for
procuring certificate guardian in name of petitioner (real mother of minors),
while appointing their as guardian of persons & property of minors namely ------------------- ------------- - -------------- --------------------stands
accepted, subject to furnishing surety bond of Rs.8,00,000/-. File be consigned
to the record room after its due completion.
